Terms and Conditions

1. Acceptance of Terms

By creating an account or using Bryckhouse AI (the "Service"), operated at bryckhouse.com (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

The Service allows registered users to generate images and video from text prompts and/or uploaded photos using third-party AI generation providers. Generation requests are queued and processed asynchronously; results, timing, and quality are not guaranteed and depend in part on infrastructure and models we do not own or control.

3. Credits and Payment

Access to generation features is provided through a prepaid credit system. Credits are purchased in fixed packs via our payment processor and are deducted from your balance at a fixed rate per generation, disclosed on the Site at the time of use. Credits have no cash value, cannot be exchanged for cash, are non-transferable between accounts, and are solely for use within the Service.

4. All Sales Are Final

All purchases of credits are final. Except where required by applicable law, we do not provide refunds, exchanges, or credits for any reason, including but not limited to:

• Dissatisfaction with generated output, or output that does not match expectations;
• Server errors, downtime, degraded performance, or unavailability of the Service;
• Errors, delays, or failures caused by third-party AI providers or infrastructure we rely on but do not control;
• Network interruptions, browser issues, or device incompatibility on your end;
• Suspension or termination of your account for violation of these Terms; or
• Any other technical malfunction, whether or not caused by us.

This section governs monetary refunds only. Separately, if an individual generation fails due to a technical error, the credits held for that specific job are, in most cases, automatically returned to your in-app credit balance for future use. This automatic credit return is a feature of how the Service is built, is not guaranteed in every circumstance, does not constitute a cash refund, and does not entitle you to a refund of the money originally paid for those credits.

5. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, error-free, or that generated output will be accurate, appropriate, or usable for any particular purpose.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we, our officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of or inability to use the Service, including damages arising from server errors, downtime, or the acts or failures of third-party providers, even if we have been advised of the possibility of such damages.

To the extent any liability is not excluded under applicable law, our total aggregate liability to you for any claim arising out of or relating to the Service will not exceed the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability for gross negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

7. Acceptable Use

You are solely responsible for the prompts, images, and other content you submit to the Service and for the output you generate. You agree not to use the Service to generate, upload, or request content that:

• Depicts a real, identifiable person without their consent, including sexual, explicit, or intimate content of any real person;
• Is illegal, exploitative of minors, or violates any applicable law;
• Infringes the intellectual property, privacy, or publicity rights of any third party; or
• Violates the acceptable use policies of our underlying AI or payment providers.

We reserve the right to suspend or terminate, without refund, any account we reasonably believe has violated this section.

8. Account Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Credits remaining in a terminated account are forfeited and non-refundable where termination results from a violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles.
